Lawsuit Filed by Boat Incident Victim’s Family Accuses Kevin O’Leary of Driving While Impaired
A lawsuit for wrongful death filed against Kevin O’Leary and his wife Linda allege that both individuals were driving a boat which collided with another craft and causing the death of Susan Brito, one of two victims who were killed in the incident.
Kevin O’Leary maintains that his wife, Linda, was driving their boat when it collided with the other vessel on Lake Joseph in southeast Canada, but the family of Brito that is suing O’Leary does not concede that Kevin wasn’t behind the wheel.
Although the lawsuit does not allege who specifically was behind the wheel at the time of the incident, it alleges that both Kevin and Linda should have checked the other for driving too fast.
The lawsuit indicates that the boat they were driving was not in optimal condition, that it did not have a proper horn and that it was not in good condition.
Claims in the suit allege that neither Kevin nor Linda were capable of safely operating their boat due to impaired judgement from alcohol, drugs or fatigue.
Additionally, the lawsuit claims that both Kevin and Linda had poor vision and had prescribed glasses which they failed to wear them on the night of the incident.
Lastly, the suit states that Kevin and Linda were texting and driving. Canadian authorities stated that Linda was driving and that she was charged with operating the boat carelessly. The driver of the other boat involved was cited for operating his boat at night without navigation lights.
Brito’s family is seeking $1 million in compensatory damages and $1 million in punitive damages. As for punitive damages, the lawsuit says Kevin and Linda “behaved with arrogance, high-handedness and have shown a callous disregard and complete lack of care.”
Linda O’Leary is charged with careless operation of a vessel in connection with the crash. A hearing for the case filed against Linda is scheduled for Nov. 21, according to reports.
